Terms and conditions of the SMS and e-mail notification services provided through www.Notify.bg by Plumtex EOOD.

Welcome to our SMS and e-mail notification service (hereinafter the “Service”). These terms and conditions (also the “Agreement”) govern the use of the Service. By using the Service, you agree to be bound by this Agreement. If you do not agree with the terms of this Agreement, do not use the Service.

Subscription

1.1. Annual subscription – Premium: the Service requires an annual subscription fee, which must be paid in full before the start of the subscription period. The subscription fee is non-refundable.

Use of the Service

2.1. Prohibited uses: you agree not to use the Service to send unsolicited or unlawful messages, to take part in phishing or fraud, or to send or link to nudity or pornographic content. We reserve the right to terminate your account immediately and without notice if we find that you have engaged in any of these prohibited uses.

Intellectual property

3.1. Ownership: we own all rights, title and interest in the Service and all materials and content provided in connection with the Service, including all intellectual property rights. You may not use the Service or any materials or content provided in connection with the Service except as expressly permitted by this Agreement.

Disclaimer of warranties

4.1. No warranties: the Service is provided “as is” and without warranty of any kind. We do not warrant that the Service will be error-free or uninterrupted, or that all defects will be corrected.

Limitation of liability

5.1. Limitation of liability: to the maximum extent permitted by law, we will not be liable for any indirect, incidental, special or consequential damages arising out of or in connection with your use of the Service, whether or not we have been advised of the possibility of such damages.

Miscellaneous

6.1. Governing law: this Agreement is governed by and construed in accordance with the laws of the Republic of Bulgaria.

6.2. Entire agreement: this Agreement constitutes the entire agreement between you and us regarding the Service and supersedes all prior or contemporaneous communications and proposals, oral or written, between you and us.

6.3. Changes: we may change this Agreement; all changes take effect immediately after they are published on the Service website. Your continued use of the Service after such changes means that you accept the new terms.
